Your dentist has a duty of care to diagnose and treat any cases of gum disease and advise you on the best course of treatment. If you have attended regularly and your dentist fails to diagnose gum disease then you may be entitled to make a dental negligence claim for compensation.
You will need to prove that your dentist failed to diagnose or treat your gum disease properly, and that this resulted in damage to your teeth, gums or jaw. You will also need to show that you suffered pain, distress or financial loss as a result of the negligence.
You have three years to bring a claim of dental negligence, from the date of negligence or knowledge of it, under the laws concerning ‘limitation’ in England and Wales. These laws state that a claimant must issue court proceedings within this time period, or else their claim is statute barred.
